All Courts that have the authority of judicial review always look into the motives underlying legal acts because sometimes perfectly legal actions that conform with the text of a law my violate the spirit of a law. The governments argument is untenable since the PM could simply suspend the legislature for any period of time to prevent the passage of legislation that he does not approve of preventing the peoples representatives from doing their jobs and convene them for only a week making legislation impossible. Boris has put the Supreme Court in an impossible position where they allow the PM unfettered power over the legislative process or the judges step into the political arena where they have hesitated to go before. Ex siempre tyrannus! (So it is with tyrants!)
